IMMIGRATION ACT OF 1990

With the passage of the Immigration Act of 1990, which took effect in the later part of 1991, the U.S. immigration system was restructured to reflect a national recognition that skilled personnel, investors, and business owners were to be given preference over others. This legislation effectively created categories that permitted relatively rapid processing of temporary and permanent visas for qualifying persons or organizations. Our specialization reflects this regulatory recognition. More recently, we increasingly provide guidance and support to foreign nationals and businesses now facing the difficulties of a less welcoming immigration environment. Our expertise includes management of employment-based and investment-based petitions, as well as EB-5 and Regional Center designations.

OUR PROCESS

Our firm accommodates our clientele by designating one attorney as the contact for each client to ensure a close working relationship and avoid inefficiencies and delays. The designated attorney analyzes the type of case, expiration and other important dates, deadlines and immigration strategies. The attorney works closely with the client, whether an individual or company, to allow a smooth transition to the firm for those who have cases pending with a government agency. If appropriate, the attorney will travel to the company’s headquarters, or any field offices, to meet with company representatives to review cases, public access files and, if necessary, any I-9 files to ensure compliance. Our clients always have complete access to the attorney by telephone, in person, and email.

OUR STAFF

David J. Hart

David J. Hart is the firm's Founder and Managing Partner since 1992. His expertise includes employment-based and investment-based petitions, EB-5 and Regional Center designations and management. He is also experienced in resolving visa denials and revocations through the Department of State, and OFAC designation representation for blocked or sanctioned persons or entities. As the Founder and Executive Director of two USCIS-approved EB-5 Regional Centers: South Florida Investment Regional Center and American Builders Regional Center, David has received USCIS approval for projects that were authorized to seek funding in excess of $180 million USD of EB-5 capital. He has prepared or participated in the preparation and adjudication of more than 250 EB-5 filings since 2010.

A graduate of the University of Miami with a Bachelor of Arts in 1986, and a Juris Doctor in 1989, David is also a member of the Florida and New York bar associations, since 1990 and 1991 respectively, and a member of the American Immigration Lawyers Association since 1992.

David J. Hart is also the Managing Director of Deco USA. He structured the Deco real estate fund model that led to the USCIS-approved Deco EB-5 offering. David manages the portfolio of Deco assets based on Deco’s cooperation agreement with Lennar International, an affiliate of Lennar Homes. In addition, he is also the founder and CEO of US MRKT (usmrkt.com), a global digital platform, that will promote and sell products and services through a worldwide network of social media sales representatives.

David is a native Canadian and immigrated to the United States decades ago. He has resided in Miami, Florida since 1985 and became a US citizen in 2000. David is fluent in English, Spanish, French and Portuguese.

Jordana A. Hart

Jordana A. Hart is the Managing Attorney with the law firm Hart & Associates in Miami, FL. She is the former Managing Attorney of David J. Hart, P.A. in Miami, FL and had a solo practice in Cambridge, Massachusetts, where she specialized in business and employment-based immigration law. She was an associate with Ross, Silverman & Levy LLP (now Ross Silverman Snyder Tietjen LLP), a nationally recognized immigration law firm in Boston, MA.

She has experience helping clients obtain H-1B, L-1, E, TN and O visas, as well as permanent residence through EB-5 investment, Labor Certification, I-140 self-petition, National Interest Waiver, and other employment-based immigration options. Her accomplishments include consular processing and waivers, U visas for victims of crime, and Temporary Protected Status (TPS), as well as family-based petitions and U.S. citizenship processes.

Jordana is admitted to practice law in the Commonwealth of Massachusetts and is a member of the American Immigration Lawyers Association (AILA). She founded and co-chaired the AILA South Florida its first Business and Investment Committee and co-chaired the chapter’s Media and Social Advocacy Committee. She has been an AILA panelist on the E-2 and O-1 Visas. She is licensed to practice U.S. law in Ontario, Canada. She has a Bachelor of Arts degree (cum laude) in History and Philosophy from Brandeis University. She graduated cum laude from Suffolk University Law School in Boston, MA with distinction in the International Law concentration.

Prior to law school, Jordana was a journalist with The Boston Globe for more than a decade. She has since written articles on immigration-related topics for The Miami Herald, Sun Sentinel, and other newspapers, as well as AILA’s Voice magazine and the American Bar Association’s International Law Committee newsletter. Jordana is a citizen of Canada and has U.S. lawful permanent residence. She speaks English, Spanish and French.

Armando Mosquera

Armando leads all operational activities for the firm while creating and maintaining organizational standards that are focused on proactive communication, effective business solutions and quick turn-around for our clients. As Office Manager, he organizes day-to-day operations, manages procedures, and maintains office efficiency by planning and implementing solutions that are in alignment with the firm’s business objectives. He designs office policies that establish standards and operational improvements while also achieving financial objectives with a clear budget administration focus.

Throughout his 20-year tenure at the firm, Mr. Mosquera has handled diverse business matters while interfacing with clients around the globe. He supports clients’ needs prior to and during their visa process and ensures each client receives wraparound services of the highest quality. He also coaches and oversees office staff to safeguard all operational matters while confirming the firm’s business activities are handled with care and efficiency.

Mr. Mosquera is a US citizen, born in Miami, Florida. He earned an Associate of Arts in Business Administration from Miami Dade College and is fluent in English and Spanish.

Susana Escobar

Susana Escobar-Godoy is the law firm’s Administrative Assistant. She has worked in the legal field for approximately six years and has been working for the firm since June 2014. Ms. Escobar-Godoy is responsible for assisting the office manager, the attorneys, and paralegals with managing appointment calendars, answering telephone and email inquiries, and compiling petition and application submission to the U.S. Citizenship and Immigration Services, the U.S. Department of Labor, and U.S. consulates, globally.

As Administrative Assistant, she manages all aspects of her role with discretion and confidentiality. She is an accomplished communicator, representing the firm professionally while acting accordingly with the highest levels of integrity. While providing comprehensive administrative support to the firm, Susana also administers the firm’s client and case database, serves as communication liaison, manages electronic and paper filing systems, and compiles sensitive data for reports and petitions.

Ms. Escobar-Godoy is a US citizen, born and raised in Miami, Florida. She is fluent in English and Spanish.
